Working together
Booking terms
Appointment length and introductory appointments
Paid appointments last 50 minutes. Free introductory appointments last 20 minutes and give us an opportunity to discuss what you’re looking for and whether working together feels suitable. I’ll always let you know when we have five minutes remaining in each type of appointment so we can bring the session to an appropriate close. If you join late, your appointment will still finish at the originally scheduled end time.
Booking, cancellations and rescheduling
Appointments cancelled at least 24 hours before their scheduled start time will receive a full refund. Appointments cancelled less than 24 hours before their scheduled start time won’t be refunded.
The same 24-hour notice period applies to rescheduling. You can reschedule without charge at least 24 hours before your appointment’s scheduled start time. Less than 24 hours before the scheduled start time, the original appointment fee won’t be refunded or transferred to a new booking. Missed appointments are non-refundable.
If I need to cancel your appointment, you’ll be offered the choice of an alternative appointment or a full refund.
Payment
Payments for paid appointments and the four-session package are taken by Moat Lane LLC, the company that provides these services. Moat Lane LLC is owned solely by me, Noel Brémond, so payment goes to the same person you work with. The fee is taken by secure payment link when the booking is confirmed.
Optional recording and access to notes
Ahead of your appointment, Fathom, an AI meeting assistant, will contact you to ask for your consent to record the session. Recording is optional, and you can have your appointment without Fathom. If you consent, I’ll keep the recording for my records unless you ask me to delete it. You’ll also automatically receive an email afterwards with access to the recording and notes, so you can revisit our discussion.
Confidentiality and secure records
What we discuss is confidential, apart from if information is requested by entities with the power to do so.
If I become concerned about your safety or the safety of others, I’ll raise it with you first and we’ll agree what happens next. If I’m not able to keep something to myself, I’ll tell you what I need to share, who it goes to and why.
If I have concerns following an appointment that wasn’t recorded by Fathom, I may make notes using your initials only. I keep these notes securely in Google Drive. My Google account is protected by two-factor authentication.
Contact between appointments
Contact between appointments is limited to practical arrangements only.
Limitation of liability
Moat Lane LLC, trading as Noel Brémond Psychology-informed Coaching, will provide its services with reasonable care and skill. Coaching supports reflection, learning and informed decision-making but doesn’t guarantee particular personal, professional or business outcomes. You remain responsible for your decisions and actions. This doesn’t remove my responsibility for the services I provide.
Nothing in these terms excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that can’t lawfully be excluded or limited. Nothing in these terms restricts your mandatory consumer rights or any refund or remedy required by applicable law.
Subject to those protections, and only to the extent permitted by applicable law, Moat Lane LLC won’t be liable for indirect or consequential losses arising out of or in connection with its services.
Subject to the same protections, Moat Lane LLC’s total aggregate liability arising out of or in connection with the services, whether in contract, negligence or otherwise, won’t exceed the total fees actually paid by you to Moat Lane LLC for all Noel Brémond Psychology-informed Coaching services supplied to you under these terms. This includes fees for all such services, rather than only the appointment or service giving rise to a claim. It’s one aggregate cap across all claims under these terms, not a separate cap for each claim. Where you haven’t paid any fees for these services, this monetary cap doesn’t apply.
Hold harmless
To the fullest extent permitted by applicable law, the client agrees to indemnify and hold harmless Moat Lane LLC, trading as Noel Brémond Psychology-informed Coaching, against third party claims, losses and reasonable legal costs to the extent caused by the client’s unlawful conduct or material breach of these terms. This obligation doesn’t apply to the extent that a claim arises from Moat Lane LLC’s or my negligence, misconduct or breach of obligations. It’s subject to the indemnity limits, claims procedure and rights protections set out in these terms.
Indemnity regarding intellectual property supplied by the client
The client confirms that they own, or have the necessary rights and permissions to provide and authorise the use of, any documents, images, data, branding, written material or other intellectual property supplied to Moat Lane LLC, trading as Noel Brémond Psychology-informed Coaching, in connection with coaching services.
The client agrees to indemnify and hold harmless Moat Lane LLC against reasonable losses, liabilities, claims and costs arising from a third party claim that Moat Lane LLC’s authorised use of material supplied by the client infringes that third party’s intellectual property rights.
This obligation doesn’t apply to the extent that a claim arises from Moat Lane LLC’s unauthorised use or modification of the material, negligence, misconduct or breach of its obligations. It’s subject to the indemnity limits, claims procedure and rights protections below.
Indemnity limits
The indemnities in the Hold harmless and Indemnity regarding intellectual property supplied by the client sections apply only where the client purchases services for purposes relating to their business, trade or profession. They don’t apply to clients purchasing services wholly or mainly for personal use. All clients must nevertheless have the necessary rights and permissions to supply material and authorise its use.
The indemnities cover only reasonable, documented losses and legal costs directly attributable to a third party claim covered by the relevant clause. They don’t cover losses caused by Moat Lane LLC’s or Noel Brémond’s unauthorised use or modification of material, negligence, misconduct or breach of their obligations.
The client’s total aggregate liability under both indemnities combined won’t exceed the total fees actually paid by that client for all Noel Brémond Psychology-informed Coaching services supplied under these terms. This is one shared cap across all claims under both indemnities, not a separate cap for each claim or clause. Where no fees have been paid, no payment is due under either indemnity.
Claims procedure
Moat Lane LLC will notify the client promptly in writing of any claim for which it seeks indemnification and provide reasonable information about the claim. Any delay in notification will reduce the client’s obligation only to the extent that the delay materially prejudices their ability to respond.
Moat Lane LLC will take reasonable steps to minimise losses and give the client a reasonable opportunity to participate in the defence or settlement of the claim, subject to any applicable insurer requirements. Both parties will cooperate reasonably.
Moat Lane LLC won’t admit liability or agree a settlement for which it seeks payment from the client without the client’s prior written consent. That consent mustn’t be unreasonably withheld or delayed. Neither party may agree a settlement that imposes an admission, payment or other obligation on the other without that party’s written consent.
Moat Lane LLC won’t recover the same loss more than once. Any recovery from another source will be taken into account when calculating the amount payable under either indemnity.
Rights protections
These provisions apply only to the extent permitted by applicable law. They don’t restrict mandatory consumer rights, any refund or remedy required by law or any liability that can’t lawfully be excluded or limited.
The indemnities don’t transfer responsibility for Moat Lane LLC’s or Noel Brémond’s own acts or omissions to the client. These rights protections and those in the Limitation of liability section apply to both indemnities and take precedence if there’s a conflict.
Suitability of services
If I develop concerns that my services aren’t suitable for you, I’ll tell you at the earliest opportunity.
Agreement to these terms
By booking an appointment, you confirm that you agree to these terms and understand that my coaching is for personal and professional development and that you aren’t experiencing emotional distress or at risk of harming yourself. You confirm that you understand coaching isn’t therapy.
